Cursory: The university of Ibadan’s International School has been fined over 200k because of a case that was filed following the schools refusal to let some students wear their hijab. Below is a run through of the court hearings and recent developments.


The University of Ibadan International School Ibadan (ISI) and four other defendants have been fined N240,000 by the Oyo State High Court in Ibadan for delaying the hearing of a lawsuit brought by female Muslim students at the school regarding the wearing of the hijab.
Earlier, it was reported that eleven female Muslim students at the school including Faridah Akerele, Aaliyah Dopesi, Akhifah Dokpesi, Raheemah Akinlusi, Imam Akinoso, Hamdallah Olosunde, Aliyyah Adebayo, Moriddiyah Yekinni, Ikhlas Badiru, Mahmuda Babarinde, Fareedah Moshood and the Muslim Rights Concern (MURIC), had instituted the suit over alleged refusal of the school to allow them wear hijabs on their school uniform.
Other respondents in the suit are the School Principal, Mrs Phebean Olowe; the Chairman, Board of Governors, Prof. Abideen Aderinto; and the Deputy Vice-Chancellor (Academics), Dr Olalekan Jeremiah; Prof. Akintunde Olatunji, Lukman Ajibade, Mrs Oluwole Olubunmi, Tunde Aro, Fatumise Abey.
On March 27, Justice Moshood Ishola put the matter on hold until the lawsuit could be heard on April 6.But after Dr. Babatunde Ajibade, counsel for the first through fifth respondents, requested at the restart of the hearing to substitute the name of the new principal, Yinka Akintunde, for the former principal of the school, Mrs. Phebean Olowe, the award of the costs followed.
Olowe had left the school, therefore Ajibade advised the judge that it was appropriate to take her name out of the lawsuit and replace it with the name of the new principal.He stated that he did not want to postpone the lawsuit’s hearing and that he wanted it to be decided on its merits.Hassan Fajimite, the attorney representing the first to eleven applicants, responded by informing the court that he was not opposed to the request for the name to be changed.
Fajimite, however, informed the court that the 1st through 5th respondents’ attorneys were aware of Olowe’s retirement as of October 2022 and that filing the application for substitute at this time would just postpone the hearing of the lawsuit.He said that given that the case was scheduled for hearing, the respondents’ attorney should not have waited until now to submit the application for substitution.
Yusuf Anikulapo, the legal representative for the 12th applicants (MURIC), agreed with Fajimite’s argument and said that the respondents had unnecessarily delayed the matter’s hearing.
Anikulapo said that the court hearing for the case has been delayed since he has only recently been served with the application for substitution.He requested that the 1st through 5th respondents be charged N100,0000 in costs.
After carefully weighing the arguments made by each of the attorneys involved, Justice Ishola approved the request for the name Olowe to be changed to Akintunde in the interest of a fair hearing.Along with that, the court granted each of the 12 applicants in the case N20,000 in costs against the 1st through 5th defendants.
The judge adjourned the matter until May 4 for hearing of the substantive application.
